I represent individuals charged with:
It is extremely important that you remain fully informed when facing criminal charges. For example, youthful offender treatment is a one-time benefit available to qualified persons under the age of 21. In this program, the most a youthful offender can face is a three-year sentence and the offense will stay off their criminal record. It is also worth noting that a first-time offender accused of a nonviolent crime may qualify for the Montgomery County Pretrial Diversion Program and avoid incarceration altogether. As with youthful offender treatment, the criminal offense will not be on the defendant's permanent record. As your criminal lawyer, I will fully inform and explain all of your legal options. My primary purpose is to keep a criminal conviction off my client's record.
In 1989, in Horne v. City of Montgomery, I appealed my client's conviction for violation of a Montgomery ordinance. The Alabama Court of Appeals reversed my client's conviction and rendered a judgment that the Montgomery City Ordinance be declared unconstitutional.
In 1993, I appealed my client's conviction for cocaine possession to the 11th Circuit Court of Appeals on the grounds of double jeopardy. Ultimately, the client won his appeal and the 11th Circuit reversed his conviction.
Effective Criminal Defense
I will ensure that law enforcement officials have followed proper procedure. For example, if there has been a violation of search and seizure rights, I will be certain to raise the proper Constitutional defense. I will zealously apply the exclusionary rule and file a motion to suppress evidence where necessary. Whatever the circumstances of your case, you may rest assured that I will fully investigate and explore all avenues of defense. I will conduct a thorough and searching discovery process to determine as much evidence as possible that the prosecutor may have against my client.
All citizens accused of a criminal offense are presumed innocent all the way through the trial, unless the prosecutor proves their guilt beyond a reasonable doubt. A seasoned criminal defense lawyer should be experienced in juror selection and should be able to select the fairest jury from the jury pool. If the prosecutor does not carry their burden of proof, my client is acquitted by the jury and thereafter he is forever innocent as a matter of law.
